GENERAL TERMS AND CONDITIONS

1. Introductory Provisions

1.1. These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the relationship between the operator of the accommodation facility Hotel Jasná (hereinafter referred to as the “hotel” or the “provider”) and natural or legal persons ordering accommodation and related services (hereinafter referred to as the “guest” or “customer”).
1.2. The GTC form an integral part of the accommodation contract. By submitting a reservation, confirming it, or checking in, the guest confirms that they have read and agreed to the GTC.
1.3. Legal relations not covered by these GTC are governed by the generally binding legal regulations of the Slovak Republic, in particular by the Civil Code.

2. Formation of Contract and Reservation

2.1. The accommodation contract is concluded upon the confirmation of the reservation by the hotel (by e-mail or via the booking system) and upon meeting the payment conditions set out in Article 3.
2.2. The guest is responsible for the accuracy of the information provided in the reservation. The hotel reserves the right to request proof of identity upon check-in.

3. Payment Terms and Invoicing

3.1. Payment of the accommodation price: 100% of the total amount is due within 24 hours from the receipt of the reservation.
3.2. All payments are made in EUR.
3.3. Method of payment: according to the details stated in the reservation confirmation or at the hotel reception. Additional services (e.g. restaurant, extras, goods) are paid at the reception upon departure unless agreed otherwise.
3.4. Non-refundable reservations: for non-refundable bookings, 100% of the price is charged immediately and is non-refundable.
3.5. In case of delayed payment, the hotel reserves the right to cancel the reservation.
3.6. Billing information or any changes to issued invoices may only be requested at the reception before the invoice is issued. No modifications are possible after issuance.

4. Cancellation Policy

4.1. Cancellation more than 14 days before arrival: no cancellation fee.
4.2. Cancellation 14 days or less before arrival: 100% of the total reservation price, non-refundable.
4.3. No-show: 100% of the total reservation price, non-refundable.
4.4. Cancellations can be made via the link in the booking confirmation email.
4.5. If the reservation has already been paid, only the amount remaining after the deduction of applicable cancellation fees will be refunded.

5. Group Reservations

5.1. For reservations of 3 or more rooms, the hotel reserves the right to set individual terms for deposits, payments, and cancellation periods. The client will be informed of these terms in writing in advance.

6. Arrival and Departure

6.1. Check-in: 15:00 – 20:00 Check-out: until 10:00.
6.2. Reception is open daily from 07:00 – 20:00. Late arrival or late departure is possible only upon prior agreement and may be subject to an additional fee according to the current price list.
6.3. In case of early departure, no refund is provided for the unused portion of the stay.

7. Taxes and Fees

7.1. Prices include VAT.
7.2. The local accommodation tax may be charged upon arrival in accordance with the applicable municipal regulation.

8. Liability for Damages and Safety

8.1. The guest is liable for any damage caused to hotel property or in common areas. The guest is obliged to act to prevent damage (§ 415 of the Civil Code) and to immediately report any threat to property or safety to the reception.
8.2. The hotel reserves the right to charge the guest’s payment card for repair or cleaning costs. The guest will be informed of such a charge.
8.3. Prohibited items: the use of cooking devices, gas appliances, or other hazardous electrical equipment in rooms is strictly forbidden. Exceptions apply to built-in appliances, standard hygiene devices (hairdryer, curling iron), and chargers.
8.4. The entire hotel, including rooms, is non-smoking. Violation may result in a cleaning fee and termination of stay without compensation. A contractual penalty of € 200 applies under Article 23.4.

9. Lost Keys / Access Cards

9.1. In case of loss or damage of a key or access card, a replacement fee of € 20 per item will be charged.

10. Stay with Pets

10.1. Accommodation with pets is not permitted.
10.2. If a guest conceals the presence of a pet, a contractual penalty of € 150 per night will apply, and the hotel reserves the right to terminate the stay without compensation.

11. Parking

11.1. The hotel guarantees one parking space per accommodation unit. A second vehicle may be redirected to an auxiliary parking area.
11.2. Parking areas are not guarded. The hotel is not liable for any damage to vehicles or for items left inside. Guests are required to lock their vehicles and not leave valuables visible.

12. Storage of Items and Sports Equipment / Lost & Found

12.1. It is strictly prohibited to store flammable substances, chemicals, toxins, explosives, or other hazardous materials in the hotel.
12.2. Sports equipment must not be stored in rooms or public areas; please use the designated storage rooms.
12.3. Lost and found items are registered and kept for 30 days. Information about retrieval procedures is available at the reception.
12.4. The hotel charges an administrative fee of € 10 plus postage costs according to the carrier’s price list for the handling and shipping of forgotten items.

13. Use of Services and Night Rest

13.1. Quiet hours are from 22:00 to 06:00. Guests must refrain from behavior that disturbs other guests beyond a reasonable level.
13.2. In case of repeated complaints, the hotel may evict the guest or terminate the stay without refund.
13.3. In the event of disturbances or disorderly conduct, the hotel reserves the right to contact the Police or other authorities.
13.4. Only registered guests are allowed in hotel rooms. Visitors are permitted only with reception approval and during reception hours.

14. Wellness Area

14.1. Access to the wellness area is permitted to adults and children aged 12 and over accompanied by an adult.
14.2. Entry is subject to prior reservation and limited capacity.
14.3. It is strictly forbidden to bring food or drinks into the wellness area. Violation is subject to a contractual penalty of € 150 and may result in denial of access.
14.4. Entry is allowed only with proper personal hygiene; guests with infectious or skin diseases are not permitted. Use of wellness facilities is at the guest’s own risk.
14.5. Violation of the wellness operating rules may lead to denial of access, termination of service, or compensation for damages.

15. Food and Beverage Consumption

15.1. Meals and beverages may only be consumed in the hotel restaurant or designated lounge.
15.2. It is prohibited to take food, beverages, or inventory outside these areas unless otherwise agreed.
15.3. The hotel is not responsible for food or beverages consumed outside the premises.
15.4. Special dietary requests (e.g. intolerances) may be subject to an additional charge and are prepared only upon the guest’s written approval of the conditions.
15.5. It is strictly prohibited to bring or consume personal food or beverages in public hotel areas (reception, lounge, restaurant).

16. Electric Vehicle Charging

16.1. Charging is only permitted at designated charging points using the hotel’s official charger.
16.2. Charging must be arranged in advance at the reception and is charged according to the current price per kWh.
16.3. The use of personal sockets or cables within the premises is prohibited. Violation may result in a contractual penalty and/or compensation for damages.

17. Withdrawal from Online Bookings

17.1. Accommodation with a fixed stay date is exempt from Act No. 102/2014 Coll. on Consumer Protection in Distance Contracts (§ 7 (6)(k)).
17.2. The consumer has no right to withdraw from such a contract without stating a reason.

18. Extraordinary Circumstances (COVID-19 and Others)

18.1. For reservations made after April 6, 2020, guests are advised to consider the risks associated with pandemics or other extraordinary events (epidemics, government restrictions, force majeure).
18.2. Payments for non-refundable bookings will not be refunded even in cases of restrictions caused by extraordinary circumstances. Guests are advised to choose refundable rates or travel insurance.

19. Personal Data Protection (GDPR)

19.1. The hotel processes personal data in accordance with applicable legislation. Details on processing purposes, legal grounds, retention periods, and data subject rights are available in the Privacy Policy – accessible via the booking confirmation, on the hotel website, and at the reception.

19.3. Questions related to data protection may be directed to the contacts provided in the Privacy Policy.

20. Complaints and Claims

20.1. Any complaints, comments, or claims must be reported immediately during the stay at the reception to allow the hotel to address the situation.
20.2. In the case of an obvious and remediable defect, the guest must provide reasonable cooperation to enable correction.

21. Amendments to the GTC

21.1. The provider reserves the right to unilaterally amend these GTC.
21.2. For each reservation, the version of the GTC valid at the time of booking shall apply.
21.3. The current version of the GTC is available on the hotel’s website and at the reception.

22. Governing Law and Final Provisions

22.1. These GTC are governed by the laws of the Slovak Republic.
22.2. If any provision of the GTC is found invalid or unenforceable, the remaining provisions remain in full effect.
22.3. These GTC take effect on August 1, 2025.

23. Smoking, Drugs, and Weapons

23.1. Smoking is strictly prohibited throughout the hotel premises except in clearly designated areas. This includes all rooms, indoor areas, and the hotel car park.
23.2. The possession, use, sale, or distribution of illegal drugs, narcotics, hallucinogens, toxic substances, or precursors is strictly prohibited throughout the hotel.
23.3. The possession of firearms, ammunition, explosives, or their components is prohibited without the hotel’s prior written consent, except as required by special legal provisions. The guest must notify the hotel in advance in such cases.
23.4. Violation of Articles 23.1 – 23.3 constitutes a material breach of these GTC. The hotel may immediately terminate accommodation without compensation and charge a contractual penalty of € 200 for smoking outside designated areas. This does not affect the hotel’s right to claim full compensation for actual damages (including extraordinary cleaning, deodorization, ozonation, or room downtime). The hotel may also request assistance from the Police.
23.5. The provisions of this article complement the smoking ban stated in Article 8.4; in case of conflict, the stricter rule applies.
